A serial masturbator who plays with himself on a nude beach will not spend another day in jail, even though his sentence has quadrupled.

In August 2019, Gary Chisholm pleaded guilty of gross indecent assault in a public place in March after pleasing himself while watching two topless girls on the nude beach of Casurina in Darwin. 

He only stayed in prison for two days because his sentence was suspended for the remainder of three months.

According to the Northern Territory News, due to Chisholm's “continuous” public masturbation record, a judge on Tuesday extended his probation to 12 months, but did not further sentence him to prison.

Chisholm was described by his lawyers as holding "almost a world record for masturbation." He was convicted twice in Queensland for playing with himself while watching swimsuit models take pictures.

Chisholm spent two days in jail because his remaining sentence of three months was suspended. On Tuesday, a judge extended his probation to 12 months without further sentence of imprisonment

He was also convicted twice in the Northern Territory for masturbating by standing at the feet of a woman in a scenic swimming pool and casuarina beach.

The Chief Judge of the Northern Territory Court of Appeals, Michael Grant, defended his decision not to return Chisholm to prison, stating that the masturbator did not commit any more crimes during his release on bail.

The prosecution appealed the original ruling on the grounds that it was “obviously insufficient”.

"[Although imprisonment] may be considered to be the low end of the acceptable outcome range, it is only clearly insufficient," he said.

"In fact, the defendant did serve a period of time in detention, at least for the first time in connection with this type of crime."

Chief Justice Grant stated that if Chisholm masturbates in public again, he will be sentenced to heavy sentences.

Chisholm was warned on Tuesday that if he masturbates in public again, he will be sentenced to prison. 

The Darwin District Court heard that Chisholm "catapulted" his erect penis on the beach in front of the teenagers at Casuarina Beach on August 25, 2019.

The court heard that a 38-year-old man saw what he was doing and told him to stop, then an argument broke out and called the police.

Judge Greg MacDonald said that everyone should have the right to conduct business on a nude beach without seeing "acts" like those committed by Chisholm.
